Blood-alcohol results can’t be used in case
Last year the Georgia Supreme Court issued a ruling that prevents prosecutors from using blood-alcohol test results against a driver accused of causing a fatal wreck. This case actually began here in Richmond Co.
The driver in this case nor the passenger appeared to be injured or arrested the night of the accident. The officer took blood samples but the court ruled he should not have without a search warrant. The passenger in the car, died 10 days after the accident. It wasn’t until that the the blood tests were completed that the driver was charged in the case.
The above case is an example of how a good DUI attorney may be able to get evidence thrown out. Part of what a DUI attorney does is to carefully examine the evidence to see if proper procedures have been followed. Often times the suppression of evidence results in a reduction or dismissal of charges.
